Understanding the Rules of Collaboration

ALHARI Gallery Affiliate Program Terms of Service

Effective Date: November 24, 2024

Welcome to the ALHARI Gallery Affiliate Program (“Program”). These Terms of Service (“Terms”) govern your participation in the Program. By applying to or participating in the Program, you agree to be bound by these Terms. If you do not agree to these Terms, you may not participate in the Program.

Eligibility

  1. Approval Required: All affiliates must submit an application and receive approval from ALHARI Gallery before participating in the Program.
  2. Relevant Niche: Affiliates must demonstrate alignment with ALHARI Gallery’s brand values and target audience, such as interests in art, digital products, or creative industries.
  3. Age Requirement: Participants must be at least 18 years old to join the Program.

Commission Structure

  • Standard Rate: Affiliates earn a 15% commission on sales generated through their referral links, unless otherwise specified in a separate collaboration agreement.
  • Special Rates: Certain products or campaigns may offer a different commission rate, which will be communicated in advance.
  • Exclusions: Commissions are not earned on:Refunded or returned purchases.
    • Purchases made by the affiliate.
    • Affiliate purchases made using their own referral link.

Tracking and Attribution

  1. Cookies: Referrals are tracked using cookies that last for 30 days. Affiliates will earn commissions for purchases made within this period.
  2. First-Click Attribution: Commissions are credited to the affiliate whose referral link was clicked first, not the last.
  3. Custom Affiliate Codes: Purchases made using an affiliate’s unique code will be credited to that affiliate. Codes have no expiration unless otherwise stated.

Payouts

  1. Payment Schedule: Commissions are processed on a Net-30 basis, meaning payouts are made 30 days after the end of the month in which the sale occurred.
  2. Payment Methods: Affiliates can choose between bank transfer or PayPal for receiving payments.
  3. Minimum Threshold: Payouts require a minimum balance of $25.00. Earnings below this threshold will roll over to the next payout cycle.
  4. Tax Reporting: Affiliates are responsible for reporting their earnings to the appropriate tax authorities. ALHARI Gallery may require tax forms to process payments, depending on jurisdiction.

Promotional Guidelines

  1. Paid Advertising Rules: Affiliates may not bid on branded keywords or use the ALHARI Gallery name in paid advertisements without prior written consent.
  2. Prohibited Claims: Affiliates must not make false or misleading claims about ALHARI Gallery’s products or services.
  3. Approved Channels: Affiliates may promote the Program through social media, blogs, and websites. Spamming or using unsolicited emails is strictly prohibited.
  4. Brand Representation: Affiliates must represent ALHARI Gallery’s brand professionally and align with its core values.

Affiliate Activity Requirements

  1. Minimum Sales Requirement: Affiliates must generate at least one sale every six months to remain active in the Program.
  2. Active Promotion: Affiliates must regularly promote ALHARI Gallery, such as creating at least one post per month on their platforms.
  3. Engagement Check: Affiliates may be required to update their promotional content or participate in affiliate program activities.

Termination

  1. Inactivity: Affiliates who do not generate any sales for one year may be removed from the Program.
  2. Violations: Affiliates may be terminated immediately for violating these Terms, including engaging in unethical behavior or prohibited promotional activities.
  3. Mutual Termination: Affiliates or ALHARI Gallery may terminate participation in the Program at any time with written notice.

Restrictions on Eligible Sales

  1. Commissions are not earned on:
    • Refunded or canceled orders.
    • Purchases made by the affiliate.
    • Affiliate purchases using their own referral link.
  2. ALHARI Gallery reserves the right to reject or reverse commissions for fraudulent or suspect transactions.

Liability Disclaimer

  1. Tools and Resources: Affiliates are responsible for ensuring they have the necessary tools, software, and resources to participate in the Program and promote ALHARI Gallery’s products. ALHARI Gallery is not liable for any affiliate’s failure to meet these requirements.
  2. No Guarantees: ALHARI Gallery does not guarantee specific results or earnings for affiliates.

Modifications

ALHARI Gallery reserves the right to modify or update these Terms at any time. Affiliates will be notified of significant changes via email or through the affiliate dashboard. Continued participation in the Program after any modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the state of Michigan, United States. Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts of Michigan.
